1.     Abbreviations and conventions

Buyer – a natural or legal person who have paid the price of a Product on Nareiko.com and, thus, have obtained certain rights linked to the Product.

Materials – all materials containing a Product that a Seller submits for sale on Nareiko.com and/or other Nareiko’s sales channels, including any information for publication, for the Buyer, for Nareiko.

Nareiko” (but not Nareiko.com), “we”, “us”, “our”, “ours” refer to Lauras Nareiko, a natural person based in Finland. Currently Lauras Nareiko conducts his business via Nareiko.com website without business registration (as a ‘light entrepreneur’) because the volume of business is below the threshold at which the business registration becomes mandatory in Finland.

Nareiko.com – a website operated by Lauras Nareiko, hosted on the domain nareiko.com. This website is an online marketplace, i.e., a place for sellers and buyers to exchange products and money.

Offering Time – time during which a Product is offered for sale on Nareiko.com.

Product – a thing offered for sale on Nareiko.com, such as virtual goods, electronic books, services, etc.

Seller – a natural or legal person who have submitted their materials to Nareiko so that they could be offered as a Product on Nareiko.com.

Terms – these Terms of Service.

Visitor – a visitor of Nareiko.com, i.e., a person viewing Nareiko.com or using it. Visitors include all Sellers and Buyers.

 

2.                 Scope

These Terms, together with our Privacy policy hosted at https://nareiko.com/content/5-privacy-secure-payment, govern the access to and use of Nareiko.com by any and all persons to the extent permissible by the applicable law.

The use of Nareiko.com includes, inter alia, relevant activities with Products, e.g., submitting any materials for sale as Products, buying Products, using Products, etc.

Nareiko.com may contain information, services, and materials from third parties and/or or provide links to third party websites not under our control (“Third-Party Materials”). Such Third-Party Materials may be subject to restrictions and terms in addition to those set out in these Terms. We do not assume any liability for any Third-Party Materials.



3.                 Acceptance of Terms

By accessing Nareiko.com, a Visitor agrees to be bound by these Terms. If the Visitor does not agree to these Terms, they must not view or use Nareiko.com.

We may change these Terms from time to time by publishing the new version here, without giving notice to anyone. It is the Visitor’s responsibility to get acquainted with the Terms before accessing and/or using Nareiko.com.



4.                 Visitor’s rights and responsibility

The Visitor is free to do anything they want on Nareiko.com, but they must not cause, intentionally or accidentally, any damage to Nareiko, Nareiko.com, Sellers and Buyers, and their legitimate interests. For example, the Visitor should not steal ideas from Nareiko.com, be they Products or anything that is a part of Nareiko.com, its communications, software, etc.

The Visitor should adhere to the best standards and practices in protecting intellectual property rights, other property, privacy, confidentiality, and in behaving ethically – ideally, in line with the corresponding international conventions and legislation of the freest countries.

The Visitor should comply with all applicable laws when accessing and using Nareiko.com.

The Visitor is entitled to all the rights granted by the European GDPR law and other applicable laws.

The Visitor may expect Nareiko to behave in accordance with the market regulations of Finland and/or applicable international laws and conventions.



5.                 Seller’s rights and responsibility

The Sellers has the right to:

a)     Submit Materials for sale on Nareiko.com and/or other Nareiko’s sales channels.

b)     Re-submit changed Materials.

c)     Withdraw a Product together with all its Materials, or some Materials of the Product only.

d)     Receive revenue in connection with the Seller’s Products according to the rules described in the Fees section hereof.

e)     If Nareiko proposes essential changes to Materials, approve or disapprove them before their publication.

f)      Initiate discussions of own Materials, Products or Nareiko.com with Nareiko, while respecting Nareiko’s right to refuse from discussing at any time.

The Seller should:

a)     Ensure that they hold the necessary intellectual property rights for their Product during the corresponding Offering Time.

b)     Ensure that the Product is original, to the best of the Seller’s knowledge, at the moment of submission of the corresponding Materials to Nareiko.

c)     Ensure that the information provided in Materials is true during the corresponding Offering Time.

d)     Agree that Nareiko may make non-essential changes to the Materials for the purposes of improving their readability, as well as for legal reasons, and/or for technical reasons. Without prior approval from the Seller, such possible changes should be limited to the reasonable minimum and should not alter the essential information.

e)     Agree that Nareiko may use the part of the Materials intended for unlimited access by the public for marketing purposes, e.g., to promote the corresponding Product or Nareiko.com.

 



6.                 Buyer’s rights and responsibility

The Buyer has the right to:

a)     Receive the Product for which the Buyer have paid.

b)     Use the Product in any legitimate way, without causing risks, threats or damage to other people and the Earth.

c)     Initiate discussions of Products or Nareiko.com with Nareiko, while respecting Nareiko’s right to refuse from discussing at any time.

d)     Complain to Nareiko about quality of Nareiko's services. An eventual complaint should be communicated to Nareiko by email: lauras.nareiko@gmail.com.

Please note that Nareiko does not accept any claims about the sold Products and does not return the money paid for the Products. This is due to the complex nature of the Products, and practical impossibility to evaluate their originality fully, to foresee the value of the Product for the Buyer, to anticipate all the risks connected with the Products, etc.

The Buyer should:

a)     Not use the Product in illegitimate ways or causing risks, threats or damage to other people or the Earth.

b)     Not to transfer, share or otherwise disclose the Product to other persons by any means, unless it is necessary for the Buyer's use of the Product AND these persons have agreed not to disclose the Product to any third persons. Exceptions are possible if the Product has already become public through no fault of the Buyer.

Fees for Buyers

 

Product sold on Nareiko.com

5% of the Seller’s Product price, at least 7 euros



8. Disclaimers

8.1. Sellers are responsible for their Products (not Nareiko).

Nareiko.com is a sales platform, a marketplace where Sellers present and sell their Products. Nareiko does not bear any responsibility for these Products: they are provided ‘as is’, and all the responsibility is on their respective Sellers.

8.2. It is impossible to verify the originality of an idea fully.

In spite of all possible effort, neither Nareiko, nor the Seller can fully guarantee that an idea is original.

To verify that an idea is original, one must compare it with all other existing ideas. It is impossible in practice, even for the largest scientific institutions. Some difficulties are: 

Not all ideas are publicly accessible, some are known to single individuals or narrow circles only.

Variations in descriptions make it difficult to compare ideas: essentially similar ideas may look very different because they are described with different words, especially in different languages.

An idea is new, original, unique, only at a certain moment, until similar ideas have not been produced. As time goes, its originality may vanish because it becomes common knowledge or better ideas appear. For example, someone else can develop the same or similar idea independently. Sometimes people ‘steal’ others’ ideas or reconstruct them, using their descriptions (like ones placed on Nareiko.com).

8.3. Value of an idea depends on the user

Obviously, value of an idea for the Buyer depends on many circumstances, including the Buyer’s personal preferences, a way of idea realization, time of realization, etc. Therefore, no statements about ideas sold on Nareiko.com serve as promises or guarantees, unless expressly stated otherwise.
